Terms and Conditions
Len G Foster – speaking, training and coaching
Last updated: 21 October 2026
These terms apply when you book coaching, workshops or speaking with me. By booking and paying, or by accepting my written proposal, you agree to them. Please read them before you book. If anything is unclear, email me first and I will explain.
- About me and these terms
I am Len G Foster (“I”, “me”). “You” means the person or organisation booking my services. You can contact me at connect@thereferraledge.com.
Part A covers coaching sessions booked online. Part B covers workshops and speaking. Part C applies to everything.
Part A – Coaching sessions
- What I offer
Coaching sessions take place online by video call (Google Meet), unless we agree otherwise. The current options are:
- The One Conversation: one 60-minute session.
- The Rehearsal: one 90-minute session.
- The Full Turnaround: three 60-minute sessions. You book the first when you pay, and I send you booking links for the second and third. Please use all three within 3 months of the first session, unless we agree otherwise.
The price shown when you book is the price you pay.
- Booking and payment
- You start with an enquiry. I reply within one working day (Monday to Friday, UK time). If another option would suit you better, I will say so. I may decline an enquiry if I do not think I can help. You pay nothing until we have agreed it is the right fit.
- I then send you a private booking link. You choose a time, shown in your own time zone, and pay in full by card through Stripe. Prices are in pounds sterling and include VAT where it applies.
- Your booking is confirmed when I receive payment. You will then get a confirmation email with your call link.
- I do not offer payment plans as standard. For larger, tailored programmes I may agree a different arrangement in writing.
- Rescheduling and cancelling
- You can reschedule or cancel free of charge up to 48 hours before your session, using the links in your confirmation email.
- If you cancel with less than 48 hours’ notice, or you do not attend, the session counts as used and I do not refund it. If something genuinely urgent has happened, tell me and I will do my best to rearrange.
- If you arrive late, the session still ends at the scheduled time, unless I am free to extend it.
- If I need to cancel or move a session, I will offer you another time or, if you prefer, a full refund for that session.
- For The Full Turnaround: if you decide not to continue after a session, I will refund the unused sessions in proportion to the price you paid, as long as you tell me before the next session is due.
- Refunds go back to the card you paid with, usually within 5 to 10 working days.
- Your right to cancel, if you are a consumer
If you book as an individual for purposes outside your business, you have a legal right under the Consumer Contracts Regulations 2013 to cancel within 14 days of booking and receive a refund.
If you want your session to take place within those 14 days, you must ask me to start, and I will ask you to confirm this when you book. If you then cancel within the 14 days after the service has started, you will pay for what I have already provided, in proportion to the full price. If the service has been fully provided, you lose the right to cancel, as you will have agreed when you booked.
This right does not apply if you book for your business. Nothing in these terms affects your other legal rights.
- What coaching is, and what it is not
Coaching is practical support to help you plan, prepare and carry out important conversations and communication. It is not therapy, counselling, or medical, legal, HR, financial or other professional advice, and I am not acting as your adviser in those areas. You stay responsible for your decisions and actions. I cannot guarantee any particular outcome, including how another person will respond. If you need professional advice, please get it from a qualified person.
- Your responsibilities
- Give me accurate information, and join on time from a suitable private place with a reliable connection.
- Treat me respectfully. I may end a session, or stop the service, if behaviour is abusive, threatening or unlawful. In that case I will refund any sessions not yet delivered.
- If your connection fails during a session, I will try to reconnect. If I lose more than 10 minutes through a fault on my side, I will give you that time back.
Part B – Workshops and speaking
- Booking, fees and payment
- Workshops, keynotes and other speaking are booked through my written proposal or confirmation, which sets out the fee, date, time, location or online format, audience and expenses. The booking is confirmed when you accept it in writing and I confirm.
- Where the proposal does not say otherwise, my invoices are payable within 30 days. If a business client pays late, I may charge statutory interest and costs under the Late Payment of Commercial Debts (Interest) Act 1998.
- Travel and accommodation are charged at cost and agreed in advance.
- You are responsible for the venue, equipment, access and accurate information about the audience, and for giving me enough notice of any changes.
- Cancelling or changing an event
Unless my proposal says otherwise, if you cancel an event:
| Notice given before the event | Fee payable |
| More than 60 days | No charge (any deposit is refunded) |
| 30 to 60 days | 50% of the fee |
| Less than 30 days | 100% of the fee |
Any expenses I have already committed that cannot be recovered are payable as well.
You may move the date once, free of charge, with at least 30 days’ notice, if I am available on the new date. Otherwise the change counts as a cancellation.
If I cannot deliver because of illness or an emergency, I will offer an alternative date or, if that is not possible, refund the fees you have paid for what I could not deliver. I am not responsible for other costs.
- Recording and materials
Please do not record, stream or photograph my sessions or presentations without my written agreement. If I agree, the recording may be used only for the purpose we agree, and not published or shared further without my permission.
Part C – All services
- Confidentiality and privacy
I keep what you tell me confidential. The only exceptions are where the law requires me to disclose it, or where I believe there is a serious risk of harm to you or someone else. I explain how I look after your personal information in my Privacy Policy, which is on my website.
- Intellectual property
All training, coaching and speaking materials, frameworks, methods, models, slides, handouts, worksheets, recordings and other content I provide or create, including the Communication Compass, belong to me.
You may use them only for your own learning during the service. Without my written permission, you may not use, copy, adapt, reproduce, share, publish or sell my materials of any kind, in any way, for your own purposes. That includes in-house training or delivery inside your own organisation, commercial gain, and white-labelling or rebranding them as your own or someone else’s.
You may not put my materials, or recordings of me, into an AI tool or system to copy, summarise for reuse, imitate or train it, or to create new training content from them, without my written permission.
The notes you make in your own sessions are yours, for your personal use.
- Testimonials and case studies
I only use your name, your words or your story publicly with your written permission. You can withdraw that permission for future use at any time.
- Images, audio and video of me
My image, my voice, my services and my offers change over time, so material that features me may stop being accurate or suitable. For that reason:
- I keep the right to ask for any photograph, audio or video in which I appear or am featured to be removed from public display. This includes material on websites, social media, event pages, video platforms and marketing, whoever published it.
- If you hold or publish such material, you agree to remove it within 14 days of my written request, or sooner where that is reasonably possible, and to take reasonable steps to have copies you control taken down. This applies to material I have agreed to, such as event recordings, and to anything you have created or published from my sessions.
- I understand that I cannot ask you to recall printed copies already distributed, or to alter private records that are not shown publicly. In those cases I ask only that you do not use the material again.
- I hold the commercial rights to my image, voice, name and likeness, and to all audio and video recordings of me, including those made at your event or during a service. You may not sell, license, advertise with or otherwise use them commercially without my written permission, and any permission I give is limited to the purpose, period and media we agree in writing.
- You may not use artificial intelligence or any other technology to create, generate, clone, simulate or alter images, audio, video or any other likeness of me, or my voice, whether or not it is shared publicly or kept private. This includes deepfakes, synthetic voices and AI avatars. Any exception needs my written permission in advance.
- You may not use my image, voice or name to suggest that I endorse a product, service or organisation without my written permission.
- If an event proposal or recording agreement sets out how recordings may be used, it also includes this right.
- Liability
Nothing in these terms limits or excludes my liability for death or personal injury caused by my negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded.
Subject to that:
- my total liability to you for anything arising from a service is limited to the fees you paid for that service;
- if you book for business purposes, I am not liable for loss of profit, revenue, business or opportunity, or for any indirect or consequential loss; and
- I am not responsible for the results of decisions you make.
If you are a consumer, this clause does not affect your legal rights, and I am responsible for foreseeable loss or damage caused by my failure to use reasonable care and skill.
- Events outside my control
Neither of us is liable for a delay or failure caused by something beyond our reasonable control, such as serious illness, severe weather, travel disruption, or a power or internet failure. If that stops a session from going ahead, I will offer a new date or refund what you paid for the part I could not deliver.
- Complaints
If you are unhappy with anything, please email connect@lengfoster.com. I aim to reply within 5 working days and to put things right fairly.
- Changes to these terms
I may update these terms from time to time. The date at the top shows when they last changed. Your booking is covered by the terms in force when you booked or accepted my proposal.
- General
- These terms, together with any written proposal, are the whole agreement between us for that booking. If the proposal and these terms conflict, the proposal applies to that booking.
- If any part of these terms is found to be invalid, the rest stays in force.
- Only you and I can enforce these terms. No one else has rights under them.
- Notices are given by email, and are treated as received on the next working day.
- These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring a claim in the courts where you live.
